Association Membership
Membership
- Every person or entity who is the Owner of record of any lot shall be a Member of the Settler’s Trace Homeowners Association.
- No Membership or initiation fee shall be charged.
- Members shall be required to pay when due the annual amounts necessary to carry on the business of the Settler’s Trace Homeowners Association.
Voting and Voting Rights
Voting Rights
- The Owners of each lot shall have one (1) vote for each Lot that they own. If two or more persons own an interest in a Lot, only one (1) vote shall be exercised by the group. (For example, a husband and wife both own a Lot. Only one (1) vote will be allowed for that family.)
- Any Member who is delinquent on any charges or dues levied by the Settler’s Trace Homeowners Association against any Lot shall not be entitled to a vote until all such charges, together with any reasonable penalties the Board of Directors of the Settler’s Trace Homeowners Association may impose, have been paid.
- On all matters, 51% of the vote is needed to carry any vote.
Assessments (HOA DUES)
Annual Assessment
- Each lot owned within the subdivision, by acceptance of a deed, is deemed to covenant and agree to pay the Settler’s Trace Homeowners Association annual assessment for the creation of a maintenance fund and special assessments when approved by the Members. The annual amount will be established each year and can be found here.
Purpose of Assessment
- The assessments levied by Settler’s Trace Homeowners Association shall be used to provide funds for such purposes as The Association may determine or for the benefit of its Members, to promote the health, safety, and welfare of the residents of the Subdivision, or for the acquisition, improvements or maintenance of properties or facilities related to the use and enjoyment of the common areas, including but not limited to the cost to repair, replacement, or additions thereto; and for the payment of taxes assessed against the common area, the procurement, and maintenance of insurance or any other needs as may arise at the discretion of Settler’s Trace Homeowners Association.
Penalty for Nonpayment of Assessment
- Assessments must be paid by the due date. Failure to pay shall result in a continuing lien against each lot, which shall include costs, reasonable attorneys fees, and interest at the rate of ten percent (10%) per annum, simple interest, from the due date. Each assessment with interest, costs, and reasonable attorney fees shall also be the personal obligation of the person who was the Owner of such property when the assessment fell due.
